Terms & Conditions

1) These terms and conditions shall apply to Mazda: Engine Shampoo SA Incentive Program 2024 in Thailand, organized by Morematics Company Limited (the “Company”). The campaign is open to Sales Advisors at Mazda authorised dealers in Thailand. By registering in the campaign, you agree to be bound by these terms and conditions.

2) The campaign period is from 1 April 2025 to 31 June 2025. The Company reserves the right to change the period.

3) To participate in the campaign, you must sell Mazda Engine Shampoo with service to end consumers at Mazda authorised dealers.

4) You can participate in the campaign by scanning a QR Code, adding @MazdaCastrol as a friend in the Line application at the service unit, registering with your personal information, and you must provide/upload job/service order (with any end consumers’ personal data, such as names, redacted) as evidence for e-coupon redemption. Should any information that may identify a Mazda consumer not be redacted, such consumer information shall not be used by the Company or BP-Castrol (Thailand) Limited under any circumstances and for any purpose whatsoever, and complete redaction of such consumer information shall take place. The entitlement to the e-coupon is as follows.

  • 4.1 For 3 Bottles of Engine Shampoo service, you will be getting Lotus’s e-coupon 100THB. (Shall be given at month-end)
  • 4.2 For 5 Bottles of Engine Shampoo service, you will be getting Lotus’s e-coupon 200THB. (Shall be given at month-end)

5) Each person registering in the campaign with a unique telephone number, or a unique Line account will be regarded as a participant.

6) Any given prize shall be not exchangeable by the winner for cash or other prizes, and the prize cannot be assigned to any third party or other juristic person.

7) In case of dispute relating to the campaign, the decision of the Company is absolute and final.

8) The Company reserves the right to change, suspend, or revise any of these terms and conditions and/or prize without prior notice.

9) The following categories of people are not eligible to participate in the campaign:

  • 9.1 the staff of BP – Castrol (Thailand) Company Limited and their Immediate Family Members. The expression “Immediate Family Members” means spouses, children, parents, brothers, and sisters.
  • 9.2 the staff of Morematics Company Limited and its related advertising agency companies and their respective Immediate Family Members.

10) If you receive prizes greater than or equal to 1,000THB value in total, you will be subject to 3% withholding tax according to Tax law of Thailand.

11) To the extent permitted by law, neither the Company nor BP – Castrol (Thailand) Limited shall be liable to you in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever (including of an indirect or consequential nature including any economic loss or other loss of turnover, profits, business or goodwill) incurred or suffered by you arising out of or in connection with the campaign.

12) These terms and conditions shall be governed by and construed in accordance with Thai law. Disputes arising out of or in connection with either the campaign or these terms and conditions shall be subject to the exclusive jurisdiction of the Thai courts.

Privacy Statement

This Privacy Statement explains who we are, what information we collect about you, how we use it, who we share it with, the lawful basis of the processing, and how long we retain it, etc. in relation to your participation of the Mazda: Engine Shampoo SA Incentive Campaign 2024 (this “Campaign”).

INFORMATION ABOUT THE CONTROLLER

The Data Controller is BP-Castrol (Thailand) Limited (the “Controller”, “Castrol”, “we”, or “us”), whose registered office is at 23rd Floor, Rajanakarn Building, 3 South Sathon Road, Yannawa, Sathon, Bangkok 10120 THAILAND. The controller is responsible for the personal data processed in this Campaign.

COLLECTION & USE OF THE PERSONAL DATA

In order to successfully register with this Campaign, you, as a Sales Advisor of a Mazda dealer, must submit to us the following personal data via Line messenger: Name and Last Name (Thai and English as appeared on Thai National I.D.), Date of Birth dd/mm/yyyy. We also have access to your Line username and profile information. We request the above information to register you for this Campaign and issue you any rewards towards the end of this Campaign. The lawful basis of processing such data is the performance of contract. Additionally, we request your Name, Last Name and Date of Birth to conduct CDD check for compliance reasons to protect us and the relationship between us and our business partner from fraud. The lawful basis of processing such data is legitimate interests.
Upon presenting us proof of sales you have successfully made, please make sure to redact any information that can identify any consumer of your dealership, so that we do not process any personal data without such consumer’s knowledge.

Where applicable, we use cookies (and similar technologies e.g. web beacons, pixels, tags, and JavaScript) to collect information about your use of the website, such as using your IP address to log your visit to our website. RECIPIENTS OF THE PERSONAL DATA

Your personal data may be disclosed to third-party service providers we engage in order to provide services to you. Disclosures to third-party service providers acting on our behalf will be subject to contractual clauses to ensure that the third parties have appropriate technical and organizational privacy and security protection measures in place. A copy of these clauses is available upon request.
We also reserve the right to disclose your personal data as required by law, or when disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on us.

TRANSFER OF THE PERSONAL DATA OUTSIDE OF THE EEA

If you are based in the EEA, we may disclose your personal data to our affiliate entities that may be located outside of the EEA. Where this is the case, your personal data shall remain at all-time protected under our comprehensive, flexible, and global compliance framework which implements appropriate measures and safeguards (including EU standard contractual clauses) to ensure that your personal data is protected in accordance with applicable data protection laws.

RETENTION PERIOD

How long we will hold your personal data will vary based on the purpose for which we are using it. We calculate the retention period based on the time the personal data is needed to: (a) fulfil the purposes described in this Privacy Statement, (b) meet the timelines required or recommended by regulatory authorities, professional bodies, or associations, (c) comply with applicable laws, legal holds, and other legal obligations (including contractual obligations), and (d) comply with your requests.

Data subject rights

You are afforded all of the rights set out below:

  • Access to your personal data. Where applicable, you are entitled to receive a copy of personal data we hold about you.
  • Correction of the personal data that we hold about you. You may request that we correct any incomplete or inaccurate data we hold about you, though we may need to verify the accuracy of the new data you provide to us. It is important that the personal data we hold about you is accurate and current.
  • Erasure of your personal data. You may request that we delete or remove personal data where there is no overriding reason for us to continue to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we have processed your personal data unlawfully or where we are required to erase your personal data to comply with our legal obligations.
  • Transfer of certain of your personal data to you or a third party. Where this right applies, we will provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format.
  • Withdraw consent. Withdrawal will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
  • Right to complain to your supervisory authority. We are committed to working with you to obtain a fair resolution of any complaint about our use of your information.
